CHILLI'S DOG SOFT PLAY WAIVER AND RELEASE OF LIABILITY AGREEMENT By entering Chilli's Dog Soft Play ("the Facility"), making a booking, or using any part of the Facility, you ("the Owner") confirm that you have read, understood and agreed to this Waiver and Release of Liability Agreement ("Agreement"). This Agreement protects Chilli's Dog Soft Play, its owners, employees, contractors, agents and affiliates from liability arising from your use of the Facility and the actions of your dog(s), guests or accompanying persons. ACKNOWLEDGEMENT OF RISK You acknowledge that use of the Facility involves inherent risks to dogs and people, including slips, trips, falls, collisions, equipment-related incidents, dog interactions, bites, scratches, illness, injury, property damage and, in rare cases, serious injury or death. Dogs can behave unpredictably, even when well-trained and socialised. Chilli's Dog Soft Play cannot guarantee the behaviour of any dog or the safety of any person or animal on the premises. By using the Facility, you voluntarily assume all associated risks. DOG HEALTH AND BEHAVIOUR You confirm that your dog is healthy and fit for exercise and play, is at least 6 months old before using elevated or jumping equipment, is up to date with vaccinations, is free from contagious diseases, infections and parasites, has no known history of aggression towards people or other dogs, and is not suffering from illness, injury or behavioural issues that may affect safety. You agree not to bring any dog showing signs of illness, aggression, distress or fear that may impact others. SOFT PLAY RULES No outdoor shoes on the play frame. No smoking, vaping or alcohol anywhere on site. No food or drinks on the play frame. Dog treats are permitted but must be cleaned up after use. The play frame is for dogs only. Adults aged 18+ may enter the frame only to assist or retrieve their dog. Children may use the soft play room and ball pit under supervision but must not use the play frame and are not covered by insurance while on it. Dogs must remain on lead until inside the soft play room with the security gate closed. Booking times must be observed. Damage caused through negligence or misuse may be charged for. Failure to comply may result in immediate removal without refund. OWNER RESPONSIBILITIES You are responsible for your dog at all times. Your dog must remain on lead until safely inside the secure play area. Your dog must remain under your supervision and control throughout the visit. You will intervene immediately if your dog presents a risk to people, dogs or property. You will follow all Facility rules and instructions. You will clean up after your dog using the products provided. You accept responsibility for any injury, loss or damage caused by your dog. EMERGENCY TREATMENT AND VETERINARY CARE In an emergency, you authorise Chilli's Dog Soft Play to seek veterinary treatment for your dog if necessary. All veterinary, transport and related costs remain your responsibility. RELEASE OF LIABILITY To the fullest extent permitted by law, you release and discharge Chilli's Dog Soft Play, its owners, employees, contractors and agents from any claims, losses, damages, costs or liabilities arising from injury, illness or death of any person or dog, dog-to-dog or dog-to-person interactions, accidents involving equipment or facilities, property loss, theft or damage, or any incident occurring while entering, using or leaving the Facility. This release applies except where liability cannot legally be excluded. INDEMNITY You agree to indemnify and hold harmless Chilli's Dog Soft Play from any claims, damages, expenses or legal costs arising from your dog's behaviour, injury or damage caused by your dog, breach of this Agreement, or third-party claims related to your use of the Facility. SELF-SERVICE FACILITY You acknowledge that the Facility may operate as a self-service venue and staff may not always be present. You are fully responsible for supervising your dog and any accompanying guests. PERSONAL PROPERTY Chilli's Dog Soft Play is not responsible for the loss, theft or damage of personal belongings RIGHT TO REFUSE ACCESS Chilli's Dog Soft Play reserves the right to refuse entry, end a session or remove any person or dog without refund if a dog displays aggressive or dangerous behaviour, an owner fails to supervise their dog, Facility rules are breached, or continued use presents a risk to people, dogs or property. ACCEPTANCE OF TERMS By making a booking, entering the Facility or using its services, you confirm that you have read and understood this Agreement, voluntarily accept all risks associated with use of the Facility, accept responsibility for your dog and accompanying persons, and agree to be legally bound by these terms
